The Canadian ELD mandate went into effect on June 12, 2021, and has a progressive enforcement period for the first 12 months. This means penalties for non-compliance will begin June 12, 2022, and until then, enforcement by Transport Canada will consist of education and awareness. 

 

The Canadian ELD mandate

The mandate, itself, aims to improve road safety across Canadian provinces and territories. It requires commercial motor vehicle drivers subject to Hours of Service (HOS) conditions to use electronic logging devices (ELDs). To level-set, an ELD is defined as a device or technology that automatically records a driver’s driving time to better track, manage, share and improve accuracy and efficiency in the driver’s record of duty status.  

U.S. v. Canadian ELD compliance 

In the U.S. the Federal Motor Carrier Safety Administration (FMCSA) requires ELD providers to register and self-certify. However, Transport Canada’s ELD mandate requires ELD providers to submit their ELDs to an accredited third-party certification body, FPInnovations, to test and verify the device meets the ELD technical standard requirements. This is the major cross-border difference.

Scope your ELD migration project 

Migrating to ELDs is a timeline of months, not weeks, depending on your fleet size. Deliberate project planning makes our fleet managers both look good and feel good knowing they’re in the driver’s seat (pun intended). This means scoping a plan that covers both hardware and software installs while thinking and taking advantage of low activity periods in your business to minimize operational impact.  

 

Communication and fleet staff training

Teaching your fleet staff how to use this technology to empower rather than inhibit them is critical. For commercial vehicle drivers, this means getting familiar with the device’s user experience, how to perform key functions, and how to work with the device when anomalous behaviour arises. Educating your back office on the change to ELDs and how to use the software, pull reports, and edit incorrect records among other actions is also imperative for a streamlined implementation. When in doubt communicate, communicate, communicate…and then communicate some more. You want everyone comfortable and ready to go before enforcement day.  

 

Realigning internal policies and procedures in fleet management

Again, being deliberate regarding the existing company policies and procedures you have in place will help. For instance, what are your policies for use of trucks by drivers while off-duty, unassigned driving time, editing ELD records, as well as how to handle ELD malfunctions? Make sure you have these policies, to begin with, validate they’re applicable, and test for effectiveness.
